Highlight of the year is the proposed Finance Bill of 2019

 

In addition to setting the tone for Nigeria's fiscal policy for 2020, the Bill seeks to promote fiscal equity, align domestic laws with global best practices, and support Micro, Small and Medium-sized businesses. Other major objectives of the Bill include increasing government revenues and stakeholder investments in investment/capital market through the introduction of incentives.

1. Guidelines on Management of Credit Concentration Risk Under The Supervisory Review Process Issue Date: March 2019 Effective Date: March 2019


2. Guidelines on The Management of Interest Rate Risk in The Banking Book (IRRBB) Issue Date: March 2019 Effective Date: January 2020


3. Guidelines for The Management of Reputational Risk Issue Date: March 2019 Effective Date: March 2019 


4. Guideline on Stress Testing for The Nigerian Banks Issue Date: March 2019 Effective Date: March 2019


The essence of the Guidelines is to set out the minimum expectations with respect to the procedures for the identification, measurement, monitoring, reporting, management and assessment of those risks and stress testing by banks in line with the requirements of the Supervisory Review Process.


5. Guidelines On The Management Of Investment Account Holders For Noninterest Financial Institutions In Nigeria March 2019


The objectives of this Guidelines is to provide the minimum standard to be met by NIFIs operating in Nigeria before they can recognize PSIA deposits as risk absorbent and thus deduct same from the computation of Risk Weighted Assets (RWAs) towards the calculation of Capital Adequacy Ratio (CAR) as specified in the Guidance Notes on Regulatory Capital For Non-Interest Financial Institutions in Nigeria issued by CBN.


6.  Guidelines On The Practice Of Smoothing The Profit Payout To Investment Account Holders For Noninterest Financial Institutions In Nigeria March 2019. 


7. Regulation On Electronic Payments And Collections For Public And Private Sectors In Nigeria Revised 2019


The objective of the Regulation is to fully align with the core objectives of the National Payments System Vision 2020 (PSV2020) to ensure the availability of safe, effective and efficient mechanisms for conveniently making and receiving all types of payments from any location and at any time, through multiple electronic channels. This will reduce the time and costs of transactions, minimise leakages in revenue receipts and at the same time provide reliable audit trails, thereby ensuring that the Nigerian Payments System aligns with international best practices.


This Regulation is therefore set out to provide all stakeholders with the operational procedures that guide end-to-end electronic payment for the Public and Private Sector.


8. Guidelines On The Issuance And Treatment Of Bankers Acceptances And Commercial Papers September 11, 2019


Issued in order to ensure uniform practice and correct treatment of Bankers Acceptances (BAs) and Commercial Papers (CPs) by Banks and Discount Houses in Nigeria, it has become imperative to issue these guidelines, to deepen and facilitate the effective and efficient functioning of the Nigerian money market.


9.   Revised Guidelines For The Registration Of Cash-Intransit And Currency Processing Companies In Nigeria


Issued in order to enhance the efficiency and cost-effectiveness of currency management, facilitate the generation of fit Naira banknotes for payment, promote the use of shared facilities to drive down currency management cost, engender healthy competition among service providers and ensure product quality, integrity and standardization in Nigeria


10.  Central Bank of Nigeria (Anti-Money Laundering and Combating the Financing of Terrorism in Banks and Other Financial Institutions in Nigeria) (Amendment) Regulations Manual.


The objective of this AML/CFT Manual is to set out policies and procedures to guide employees and the Bank to conduct business in accordance with applicable Anti-Money Laundering (AML) laws and regulations. The manual aims to establish procedures and minimum standards to protect the CBN from being used as a channel to launder money, finance terrorism and other forms of financial crimes.


11. 2019 Regulatory And Supervisory Guidelines For The Operations Of Mortgage Guarantee Companies (Mgc) Central Bank Of Nigeria November 2019


12.  Central Bank Of Nigeria Consumer Protection Regulations


The objective of the Guidelines is to protect consumers against the unethical and predatory practices that undermine consumer confidence in the use of financial services. The Guidelines therefore sets out the minimum standards expected from Financial Institutions on responsible business conduct.


13.  The Guide To Charges By Banks, Other Financial And Non-Bank Financial Institutions January 1, 2020


The "Guide to Charges by Banks, Other Financial and Non-Bank Financial Institutions" (the Guide) provides a basis for the application of charges on various products and services offered by Financial Institutions in Nigeria to their customers. This document applies to all financial institutions licensed and/or regulated by the Central Bank of Nigeria.

SEC 

Highlight of the year was the release of the exposure draft of the Investment and Securities Bill of 2019 which is expected to repeal the ISA 2007 and enact the Investments and Securities Acts (ISA), 2019.

 

The Securities Exchange Commission issued new rules and rule amendment of the Nigerian Stock Exchange approved on the 6th of April, 2019. The rules issued are as follows:

AMCON

 

The AMCON Act saw an amendment in 2019 with the signing of the AMCON amendment Act of 2019.

 

The aim of the Act was to broaden the powers of AMCON and help it to better achieve the purpose for which it was set up. The amendment stripped off the layer of protection afforded by bank-client privacy by giving the corporation powers to dig into the financial details of debtors and call up any record or trace any fund of any debtor held in Nigeria or in a foreign country. 

 

The amendment also empowers the Corporation to make a list of debtors and make same available to the government and also issue a statement that a debtor is not in good standing thus make contracting with the government impossible.

 

FMDQ

 

The FMDQ with the support of the CBN developed the Fixed Income Securities Investment Clients Services ("FISICS") Guidelines in February 2019. The FISICS Guidelines were developed to guide the market operations, standards and conduct of Dealing Members as well as Custodians in respect of their treatment of Clients investing in Fixed Income Securities and are designed to cover the value chain of the Investment Client Service. They are to be read in conjunction with the Guidelines, FMDQ OTC General Market Rules, Membership Agreements, FMDQ OTC Market Bulletins and such other regulation, as may be prescribed by FMDQ and other relevant regulatory authorities from time to time.
